1. Scope & Parties

1.1. These Terms & Conditions (the “Terms”) apply to all contracts between Vérité Drive (“we”, “us”, “our”, organiser) and any customer (“you”, “Client”, “Participant”) for participation in luxury automotive motorsport events, track days, driving tours and related services (the “Events”).

1.2. By booking an Event, you accept and agree to these Terms in full. If you book on behalf of others, you guarantee they also comply with these Terms and you are jointly and severally liable.

1.3. Services may include: event organisation, track access, coaching, vehicle hire, accommodation, transfers, hospitality and extras.

2. Booking & Payment

2.1. To secure your place you must complete the registration process and pay the required deposit (as indicated in the event-specific reservation pack). The deposit is refundable under the conditions set out in Clause 4.

2.2. The base price of the Event must be paid in full prior to departure (i.e., before you arrive at the Event location).

2.3. Any goods or services booked as extras (vehicle hire, upgrades, helicopter transfers, enclosed car transport, etc.) will be invoiced after the Event and must be settled within the invoice terms.

2.4. All payments must be in EUR by wire transfer unless otherwise agreed. Any costs for currency conversion or bank charges are borne by you.

All payments from the sender’s side charges are your responsibility.

3. Price, Amendments & Availability

3.1. Prices depend on the Event, inclusions, vehicle hire options and number of participants. Final price will be confirmed in your reservation pack.

3.2. We reserve the right to amend Event details (dates, times, locations, venues or suppliers) if required due to safety, circuit availability, number of bookings or other compelling reasons. We will notify you as soon as possible.

3.3. In the event of such changes, we will offer either (i) a suitable alternative Event or (ii) a credit towards a future Event. We shall not be liable for travel/accommodation costs you have already incurred.

4. Cancellation, Refunds & Transfer of Booking

4.1. If you cancel within 7 days of registering (and before your place is confirmed) you are eligible for a refund of 90% of the deposit.

4.2. Once bookings and supplier arrangements are confirmed, cancellation by you will incur a 50% fee of the total Event price (including deposit).

4.3. Transfer of your booking to another person is permitted only with our prior written consent; the transferee must satisfy all eligibility criteria and you remain ultimately liable.

4.4. If we cancel the Event due to force majeure or venue unavailability, we will issue a credit for the full amount paid, valid for a future Event (validity period to be agreed).

4.5. No refunds will be granted for your travel, accommodation or other expenses incurred if the Event proceeds as scheduled.

5. Participants, Vehicles & Insurance

5.1. You must hold a valid driving licence suitable for the vehicle you will drive, and your vehicle must be in good technical condition, suitable for track use and compliant with the circuit’s regulations.

5.2. If you hire a vehicle from us or a supplier we appoint, we provide insurance for the vehicle, except you will be liable for a deductible (franchise) of 10% of the vehicle’s agreed value.

5.3. If you bring your own vehicle, you are responsible for obtaining appropriate track-use insurance, and we strongly recommend you ensure third-party liability and driver/passenger cover.

5.4. We accept no liability for damage caused by you, your vehicle or your guest(s) to other participants, property, the circuit or venue unless caused by our gross negligence or wilful misconduct.

6. Safety, Conduct & Rules

6.1. You must at all times follow the instructions of the Event director, circuit officials, marshals, coaches and venue staff. Failure to comply may result in exclusion from the Event without refund.

6.2. Use of alcohol or drugs before or during track sessions is strictly prohibited. 6.3. Public racing, timed competition or “top speed” attempts are not permitted unless confirmed beforehand.

6.4. You must attend mandatory driver briefing sessions, sign all indemnity and waiver documents and obey the circuit’s noise, safety, and vehicle regulations.

7. Liability & Indemnity

7.1. You participate at your own risk. Motorsport activities are inherently dangerous. While we strive for high safety standards, accidents may happen. (See [similar wording] in Standard track day T&Cs).

7.2. Our liability to you is limited to direct damages only and shall not exceed the total price you paid for the Event. We are not liable for any indirect or consequential loss (including travel costs, loss of profit or business opportunity) unless caused by our gross negligence or wilful misconduct.

7.3. You agree to indemnify and hold us harmless against all claims, costs or damages arising from your negligence, breach of these Terms, your vehicle or acts of your guests.

8. Intellectual Property & Image Rights

8.1. We own the copyright and other rights to all materials, photos, videos and highlights produced in connection with the Event. By participating you grant us the right to use your image and likeness for promotional purposes unless you notify us in writing prior to the Event.

8.2. You may not use our logos, trademarks or promotional materials without our express written permission.

9. Privacy & Data Protection

9.1. We will collect, use and store your personal data only for Event management, marketing and related purposes, in accordance with applicable data protection laws (EU GDPR, Belgian law).

10. Governing Law & Dispute Resolution

10.1. These Terms are governed by the laws of Belgium. The courts of Brussels judicial district shall have exclusive jurisdiction unless otherwise required by law.

10.2. If any provision hereof is invalid or unenforceable, the remainder of the Terms shall remain in full force.
